Earlier, the Islamabad High Court had directed the federal government to transfer all authorities of the Capital Development Authority (CDA) to the Islamabad Metropolitan Corporation (IMC) for analysis.
According to the report, Justice Mohsin Akhtar Kiyani of the Islamabad High Court heard two petitions challenging the 2015 statutory regulatory order (SRO) issued by the CDA, which imposed right-of-way charges on petrol pumps and CNG stations on Islamabad’s main roads.
It should be noted that the CDA is a civic body established in 1960 entrusted with the development work of the federal capital. The institution plays a crucial role in urban development and administration according to the CDA’s official website.
Justice Mohsin Akhtar Kiyani issued a written decision, stating that the CDA collected Rs. 33,74,856 in taxes from applicants, which is an illegal act and contrary to Article 77 of the Constitution, which stipulates that taxation powers can only be exercised with the approval of Parliament.

Justice Mohsin Akhtar Kiyani remarked that the direct imposition of taxes or charges by the CDA under the CDA Ordinance 1960, based on municipal duties under Sections 88, 89, and 90 of the Local Government Act 2015, is an illegal act.
The court decision stated that it is time for the federal government to take appropriate steps under Section 52 of the CDA Ordinance 1960 to terminate the authority’s functions and conduct a formal analysis of the agency as the original purpose of the CDA has been fulfilled.
The administration, regulations, and civic governance of Islamabad are now governed under the Local Government Act 2015, which is a special legislation aimed at governing local government through elected representatives.”
