ISLAMABAD: The Islamabad High Court has issued an order to relocate the imprisoned Pakistan Tehreek-e-Insaf (PTI) Chairman, who is currently detained in connection with the cipher case, to Adiala Jail.

Chief Justice Aamir Farooq of the Islamabad High Court presided over the PTI Chairman’s plea concerning his incarceration conditions.

During the proceedings, Chief Justice Aamir Farooq of the Islamabad High Court observed that the PTI Chairman is an under-trial prisoner in the cipher case, and all under-trial prisoners in Islamabad are typically held at Adiala Jail. He questioned why the under-trial prisoner was being kept at Attock Jail instead of Adiala.

Justice Amir Farooq inquired further, mentioning that the PTI Chairman had been placed in Attock Jail in connection with the Tosha Khana case, and since that sentence had been suspended, it raised the question of whether he should be relocated to Rahim Yar Khan.

The Islamabad High Court requested a response from Additional Attorney General Manoor Iqbal Dogul.

The Chief Justice of Islamabad emphasized that, in accordance with the law, under-trial prisoners in Islamabad should be housed at Adiala Jail. Therefore, the PTI Chairman should be transferred to Adiala Jail.

Justice Amir Farooq noted that it had been reported that AB and C class accommodations were now available in the jail.

Barrister Salman Safdar, representing Imran Khan, stated that the jail now offers a normal and improved class of accommodations, which the PTI Chairman is entitled to. Justice Amir Farooq affirmed that it is established that the PTI Chairman is entitled to better accommodations. He stressed that as a former prime minister and an educated individual, the PTI Chairman should receive the entitlements prescribed by jail regulations. It was imperative to ensure that none of the Chairman’s rights were forfeited.

It is worth noting that the PTI Chairman was sentenced to a three-year prison term on August 5, 2023, in connection with the Tosha Khana case. He was apprehended in Lahore and incarcerated in Attock Jail. Subsequently, he was also arrested in the cipher case.

While the Islamabad High Court had suspended the PTI Chairman’s sentence in the Tosha Khana case, his release was not possible due to his arrest in the cipher case.
